This privacy policy (hereinafter referred to as “Privacy Policy”) explains how any personal data collected will be processed and protected by the Foreign Workers Transformation Approach Sarawak Foreigners Health Information System (hereinafter referred to as “SAFHIS”) approved clinics/hospitals/medical facilities in relation to the mandatory medical examination of foreign workers (hereinafter referred to as “Foreign Worker(s)”) seeking employment in Sarawak. Please read this Privacy Policy carefully as it forms part of the terms and conditions (hereinafter referred to as “Terms and Conditions”) of this website. By using this website, you agree to and accept the Privacy Policy set forth below together with our Terms and Conditions.
We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of this Privacy Policy. You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy after the date such revised Privacy Policy is posted.
“Personal data or information” means any information or data in connection with any actual or potential transaction(s)/relationship with SAFHIS, which relates directly or indirectly to Foreign Worker(s), who is identified or identifiable from that information or from that and other information in our possession and includes information such as the Foreign Worker(s)’ name, identity card, passport or other identification document(s), telephone numbers(s), mailing address(es), place of birth, age, occupation, marital status, information and any other information relating to Foreign Worker(s) which may have been submitted to your clinic/hospital/medical facility. Personal data or information may include sensitive personal data which relates to information relating to a Foreign Worker’s health, political opinions, religious beliefs or other beliefs of a similar nature, the commission or alleged commission of any offense or any other information as may be prescribed by privacy legislation/laws.
Please be informed of the following:
- Personal data (hereinafter referred to as “Personal Data”) includes all data defined within the Personal Data Protection Act 2010 (hereinafter referred to as “PDPA”) including all data disclosed to SAFHIS approved clinics/hospitals/medical facilities.
- That the Personal Data provided by Foreign Worker(s) in relation to the Foreign Workers Medical Examination is for the purpose of the medical examination only.
- That the Foreign Workers’ Personal Data shall be accessible to your clinic/hospital/medical facility, Jabatan Kesihatan Negeri Sarawak (hereinafter referred to as “JKNS”), Jabatan Imigresen Malaysia Sarawak (hereinafter referred to as “JIMS”), and the Immigration and Labour Management Unit (hereinafter referred to as “ILMU”).
- That you shall hereby agree to:
- Store and process the Personal Data of Foreign Workers
- Store and process the Personal Data of the employer(s) of Foreign Workers (hereinafter referred to as “Employer(s)”)
- Take reasonable endeavours to implement reasonable and appropriate technical and organisational security measures to protect all personal data of Foreign Workers and Employers within your custody or control against unauthorised or unlawful processing and accidental destruction or loss.
- Disclose an Employer’s and/or Foreign Worker’s Personal Data to the relevant governmental authorities including JKNS, JIMS, and ILMU, whenever required by law or for legal purposes.
- Following a medical examination of a Foreign Worker by your clinic/hospital/medical facility, your clinic/hospital/medical facility shall upload and/or key in the medical report to the SAFHIS system.
- That the Personal Data provided to you in the websites owned and/or operated by SAFHIS includes the Foreign Worker’s and/or Employer’s name, personal particulars and/or contact numbers.
- That in addition to the Personal Data of Foreign Worker(s) provided by Employers, you may also obtain and process the Personal Data from other sources, including:
- Passport, calling visa or permit (if any) provided to SAFHIS
- Government or other regulatory authorities who have the power and/or authority to disclose such information (for example, JIMS, ILMU and JKNS)
- Where otherwise lawfully permitted
- That you will process the Personal Data of Foreign Workers and Employers in accordance with the Personal Data Protection Act (hereinafter referred to as “PDPA”) 2010 and any applicable Malaysian laws.
- That you may contact SAFHIS Customer Service Department at admin.safhis@sarawak.gov.my for any inquiries in respect to a Foreign Worker’s and/or Employer’s Personal Data.
- That you shall not disclose a Foreign Worker’s or Employer’s Personal Data to any third party except to the Government of Malaysia.
- That you shall make a declaration to maintain the privacy and confidentiality of all personal information of Foreign Workers and their Employers.
