This privacy policy (hereinafter referred to as “Privacy Policy”) explains how any personal data collected will be processed and protected by the Foreign Workers Transformation Approach Sarawak Foreigners Health Information System (hereinafter referred to as “SAFHIS”) approved clinics/hospitals/medical facilities in relation to the mandatory medical examination of foreign workers (hereinafter referred to as “Foreign Worker(s)”) seeking employment in Sarawak. Please read this Privacy Policy carefully as it forms part of the terms and conditions (hereinafter referred to as “Terms and Conditions”) of this website. By using this website, you agree to and accept the Privacy Policy set forth below together with our Terms and Conditions.
We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of this Privacy Policy. You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy after the date such revised Privacy Policy is posted.
“Personal data or information” means any information or data in connection with any actual or potential transaction(s)/relationship with SAFHIS, which relates directly or indirectly to Foreign Worker(s), who is identified or identifiable from that information or from that and other information in our possession and includes information such as the Foreign Worker(s)’ name, identity card, passport or other identification document(s), telephone numbers(s), mailing address(es), place of birth, age, occupation, marital status, information and any other information relating to Foreign Worker(s) which may have been submitted to your clinic/hospital/medical facility. Personal data or information may include sensitive personal data which relates to information relating to a Foreign Worker’s health, political opinions, religious beliefs or other beliefs of a similar nature, the commission or alleged commission of any offense or any other information as may be prescribed by privacy legislation/laws.
Please be informed of the following:
  • Personal data (hereinafter referred to as “Personal Data”) includes all data defined within the Personal Data Protection Act 2010 (hereinafter referred to as “PDPA”) including all data disclosed to SAFHIS approved clinics/hospitals/medical facilities.
  • That the Personal Data provided by Foreign Worker(s) in relation to the Foreign Workers Medical Examination is for the purpose of the medical examination only.
  • That the Foreign Workers’ Personal Data shall be accessible to your clinic/hospital/medical facility, Jabatan Kesihatan Negeri Sarawak (hereinafter referred to as “JKNS”), Jabatan Imigresen Malaysia Sarawak (hereinafter referred to as “JIMS”), and the Immigration and Labour Management Unit (hereinafter referred to as “ILMU”).
  • That you shall hereby agree to:
    • Store and process the Personal Data of Foreign Workers
    • Store and process the Personal Data of the employer(s) of Foreign Workers (hereinafter referred to as “Employer(s)”)
    • Take reasonable endeavours to implement reasonable and appropriate technical and organisational security measures to protect all personal data of Foreign Workers and Employers within your custody or control against unauthorised or unlawful processing and accidental destruction or loss.
    • Disclose an Employer’s and/or Foreign Worker’s Personal Data to the relevant governmental authorities including JKNS, JIMS, and ILMU, whenever required by law or for legal purposes.
    • Following a medical examination of a Foreign Worker by your clinic/hospital/medical facility, your clinic/hospital/medical facility shall upload and/or key in the medical report to the SAFHIS system.
  • That the Personal Data provided to you in the websites owned and/or operated by SAFHIS includes the Foreign Worker’s and/or Employer’s name, personal particulars and/or contact numbers.
  • That in addition to the Personal Data of Foreign Worker(s) provided by Employers, you may also obtain and process the Personal Data from other sources, including:
    • Passport, calling visa or permit (if any) provided to SAFHIS
    • Government or other regulatory authorities who have the power and/or authority to disclose such information (for example, JIMS, ILMU and JKNS)
    • Where otherwise lawfully permitted
  • That you will process the Personal Data of Foreign Workers and Employers in accordance with the Personal Data Protection Act (hereinafter referred to as “PDPA”) 2010 and any applicable Malaysian laws.
  • That you may contact SAFHIS Customer Service Department at admin.safhis@sarawak.gov.my for any inquiries in respect to a Foreign Worker’s and/or Employer’s Personal Data.
  • That you shall not disclose a Foreign Worker’s or Employer’s Personal Data to any third party except to the Government of Malaysia.
  • That you shall make a declaration to maintain the privacy and confidentiality of all personal information of Foreign Workers and their Employers.

Dasar Privasi ini (selepas ini dirujuk sebagai “Dasar Privasi”) menerangkan bahawa mana-mana data peribadi yang dikumpul akan diproses dan dilindungi oleh klinik / hospital / kemudahan perubatan yang diluluskan oleh Foreign Worker Transformation Approach Sarawak Foreigners Health Information System (selepas ini dirujuk sebagai "SAFHIS") sehubungan dengan pemeriksaan wajib kesihatan pekerja asing (selepas ini dirujuk sebagai “Pekerja Asing”) yang mencari pekerjaan di Sarawak. Sila baca Dasar Privasi ini dengan teliti kerana ia merupakan sebahagian daripada terma dan syarat (selepas ini dirujuk sebagai "Terma dan Syarat") laman web ini. Dengan menggunakan laman web ini, anda bersetuju dan menerima Dasar Privasi yang dinyatakan sekali dengan terma dan syarat kami.
Kami berhak untuk membuat perubahan ke atas Dasar Privasi ini pada bila-bila masa dan untuk apa-apa jua sebab. Kami akan memaklumkan anda mengenai sebarang perubahan dengan mengemas kini tarikh "Kemas kini Terakhir" dalam Dasar Privasi ini. “Data peribadi atau maklumat peribadi” bermaksud sebarang maklumat atau data berkaitan dengan sebarang transaksi/kerjasama bersama kami yang berkait dengan anda dan pekerja asing secara langsung atau tidak langsung, yang dikenal pasti atau boleh dikenal pasti daripada maklumat tersebut atau daripada maklumat lain milikan kami dan termasuk maklumat berkaitan Pekerja Asing seperti nama, kad pengenalan, pasport, dokumen pengenalan yang lain, nombor telefon, alamat surat menyurat, tempat lahir, pekerjaan, status perkahwinan, dan mana-mana maklumat yang mungkin diberikan kepada klinik / hospital / kemudahan perubatan anda. Maklumat peribadi termasuklah data peribadi sulit mengenai Pekerja Asing seperti kesihatan, pendapat politik, kepercayaan agama atau mana-mana kepercayaan yang serupa, melakukan atau didakwa melakukan kesalahan jenayah atau sebarang maklumat lain seperti yang mungkin ditetapkan oleh undang-undang/ perundangan privasi.
Sila ambil maklum perkara berikut:
  • Data peribadi (selepas ini dirujuk sebagai "Data Peribadi") termasuk semua data yang ditakrifkan dalam Akta Perlindungan Data Peribadi 2010 termasuk semua data yang telah didedahkan kepada klinik / hospital / kemudahan perubatan SAFHIS.
  • Data Peribadi yang diberikan oleh Pekerja Asing sehubungan dengan Pemeriksaan Perubatan Pekerjaan Asing hanya untuk tujuan pemeriksaan perubatan.
  • Data Peribadi Pekerja Asing boleh diakses oleh klinik/hospital/kemudahan kesihatan, Jabatan Kesihatan Negeri Sarawak (selepas ini dirujuk sebagai “JKNS”), Jabatan Imigresen Malaysia Sarawak (selepas ini dirujuk sebagai “JIMS”), dan Unit Pengurusan Imigresen dan Tenaga Kerja (selepas ini dirujuk sebagai “ILMU”).
  • Dengan ini anda memberikan persetujuan anda kepada SAFHIS untuk:
    • Menyimpan dan memproses Data Peribadi Pekerja Asing
    • Menyimpan dan memproses Data Peribadi Majikan Pekerja Asing (selepas ini dirujuk sebagai ”Majikan”)
    • Berusaha secara munasabah untuk melaksanakan langkah-langkah keselamatan teknikal dan sekuriti organisasi yang sewajarnya dan bersesuaian dalam melindungi semua Data Peribadi Pekerja Asing dan Majikan yang berada di bawah penjagaan atau kawalan anda daripada hal-hal yang tidak dibenarkan atau menyalahi undang-undang dan kemusnahan atau kehilangan secara tidak sengaja.
    • Mendedahkan Data Peribadi Majikan dan/atau Pekerja Asing kepada pihak berkuasa kerajaan yang berkaitan termasuk JKNS, JIMS, dan ILMU, pada bila-bila masa yang diperlukan oleh undang-undang atau untuk tujuan undang-undang.
    • Selepas pemeriksaan perubatan Pekerja Asing oleh klinik / hospital / kemudahan perubatan anda, klinik / hospital / kemudahan perubatan akan memuat naik dan / atau memasukkan laporan perubatan ke sistem SAFHIS.
  • Bahawa Data Peribadi yang diberikan kepada anda dalam laman web yang dimiliki dan/atau dikendalikan oleh SAFHIS termasuk nama Pekerja Asing dan/ atau Majikan, butiran peribadi dan / atau nombor untuk dihubungi.
  • Bahawa selain Data Peribadi Pekerja Asing yang disediakan oleh Majikan, anda juga boleh memperoleh dan memproses Data Peribadi daripada sumber lain, termasuk:
    • Pasport, visa panggilan atau lesen (jika ada) yang diberikan kepada SAFHIS
    • Kerajaan atau pihak berkuasa lain yang mempunyai kuasa dan/atau hak untuk mendedahkan maklumat tersebut (contohnya, JIMS, ILMU dan JKNS)
    • Di mana sebaliknya dibenarkan secara sah
  • Bahawa anda akan memproses Data Peribadi Pekerja Asing dan Majikan mengikut Akta Perlindungan Data Peribadi (selepas ini dipanggil “PDPA”) 2010 dan mana-mana undang-undang Malaysia yang berkenaan.
  • Bahawa anda boleh menghubungi Bahagian Khidmat Pelanggan SAFHIS di admin.safhis@sarawak.gov.my untuk sebarang pertanyaan mengenai Data Peribadi Pekerja Asing dan/atau Majikan.
  • Bahawa anda tidak boleh mendedahkan Data Peribadi Pekerja Asing atau Majikan kepada mana-mana pihak ketiga selain Kerajaan Malaysia.
  • Bahawa anda akan membuat kenyataan untuk mengekalkan privasi dan kerahsiaan semua maklumat peribadi Pekerja Asing dan Majikan mereka.

    The certification of whether a Foreign Worker is fit or unfit for work shall be determined by SAFHIS approved panel medical clinics and/or hospitals. SAFHIS shall not be liable or responsible for any damage suffered or to be suffered as a result of any approval or certification by such approved SAFHIS panel medical clinics and/or hospitals of whether a Foreign Worker is medically fit or unfit for work.
  • Indemnity
    You hereby irrevocably agree to indemnify and keep indemnified SAFHIS from all liabilities, claims, losses and expenses, including any legal fees that may be incurred by SAFHIS in connection with or arising from your use or misuse of this website and the services provided herein, or your breach of these terms and conditions howsoever occasioned, or any intellectual property right or proprietary right infringement claim made by a third-party against SAFHIS in connection with your use of this website.
  • Termination or Suspension
    SAFHIS reserves the right to terminate and/or suspend your access to this website and/or your use of this website at any time, for any reason. System Administrator
This Terms of Reference outlines the roles and responsibilities of the Administrator (hereinafter referred to as “Administrator”) for the Foreign Workers Transformation Approach Sarawak Foreigner Health Information System (hereinafter referred to as “SAFHIS”).
Roles and responsibilities:
  • Onboarding of approved stakeholders: The Administrator will onboard approved SAFHIS medical practitioners, clinics, hospitals, medical facilities (X-Ray and laboratory personnel), authorised JKNS, ILMU and JIMS staff, on the SAFHIS system.
  • Manage medical records: Maintain accurate and up-to-date medical records of Foreign Workers and liaise with approved medical institutions when necessary. This includes creating and updating electronic medical records (EMRs) and ensuring that all information is entered correctly.
  • Data confidentiality: The Administrator will ensure that the medical records of Foreign Workers and personal information on SAFHIS are maintained with strict confidence; and does not share or disclose any confidential or sensitive information to unauthorised parties.
  • Communicate with and assist stakeholders: The Administrator will communicate with panel healthcare institutions, employers, JKNS, JIMS and ILMU. This includes relaying information about a Foreign Worker’s medical test results, and other important information, to the relevant parties.
  • Review SAFHIS panel applications: The Administrator will approve or reject medical institutions applying for SAFHIS panel membership.
  • Managing User Accounts: The Administrator is responsible for creating, managing, and deleting user accounts for approved SAFHIS panel medical clinics and/or hospitals, and authorised government agencies. This includes ensuring that users have the appropriate access levels and permissions for their roles.
  • System Maintenance: The maintenance of the SAFHIS systems, including performing regular updates, monitoring system performance, and troubleshooting issues.
  • Security Management: The implementation and maintenance of appropriate security measures for SAFHIS computer systems and data. This includes implementing firewalls, anti-malware, and intrusion detection systems, as well as ensuring that all users follow security best practices.
  • Data Backup and Recovery: The Administrator is responsible for regularly backing up data and implementing appropriate disaster recovery procedures in case of a data loss or cyber attack.
  • Software and Hardware Management: The management of the SAFHIS software and hardware inventory, including purchasing and replacing equipment as necessary, and ensuring computer systems are used only for legitimate business purposes.
